We offer a specialist Professional Regulatory service to Dentists and Dental Professionals regulated by the General Dental Council (GDC).
The General Dental Council (GDC) is the regulatory body responsible for:
- clinical dental technicians
- dental hygienists
- dental nurses
- dental technicians
- dental therapists
- orthodontic therapists
Some dental professionals may be accepted on to one of the GDC’s 13 Specialist Lists and can then call themselves a ‘specialist’.
As part of their duty to protect the public, the GDC can remove or restrict a dental professional’s registration if they fall seriously short of the high standards expected.
The GDC can consider cases where a registrant's fitness to practise may be impaired due to:
- conduct, including convictions and cautions
The investigation process
1. If an allegation is made to the GDC, a caseworker decides whether it is appropriate for the GDC to deal with.
2.If there may be a case to answer, the caseworker refers the matter to an Investigating Committee, which may take no further action, issue an advice letter, issue a warning, or refer the matter to a Practice Committee. It can also issue an interim suspension while the matter is investigated further.
3. One of the three Practice Committees then consider the matter:
- Professional Conduct Committee (PCC)
- Professional Performance Committee (PPC)
- Health Committee (HC)
4.The respective Committees then decide whether the specialist’s fitness to practise is impaired and can then issue:
- Suspension with or without a review
- Erasure (except the Health Committee)
- Immediate suspension
- Immediate Conditional Registration
The PCC can also restore a professional to the Register.
At any stage, you may be subject to an interim suspension order while the appropriate committee considers your case. In addition, the Council for Healthcare Regulatory Excellence has the power to appeal any decision of the Fitness to Practise panel on the grounds that it is ‘unduly lenient’.
How we can help
There is comprehensive information in our Employment pages on the legal support we can offer dental professionals for any workplace situation, including:
- Drafting grievances
- Harassment and bullying
- GDC Appeal Tribunal Hearings
- Internal disciplinary investigations & hearings
- Employment tribunal litigation
- Disclosure & Barring Service representations
- Investigation by the GDC
- High Court Injunctions
- GDC Fitness to Practise Hearings
- High Court Judicial Reviews
- GDC Interim Orders Panel Hearings
If you have been suspended or are under investigation, please contact us as a matter of urgency. It is much better to get advice at this stage, rather than risking the potential consequences for your career if the matter goes further. Anything that calls into question your suitability to remain on the GDC Register can have far-reaching consequences.
As a member of a regulated profession, we are fully aware that any investigation or disciplinary process is very stressful, as it will usually go to the heart of your professional practice. We can support you throughout this process, with pragmatic, considered advice. Should the committee decision go against you, we can advise you on the likelihood of success at appeal and can represent you robustly in proceedings in the High Court or Court of Session.
