Civil Harassment

For people who are in apprehension of harassment or are being harassed, and wish to take action themselves, and/or for people accused of harassment and facing civil claims in the County or High Court under the Protection from Harassment Act 1997. This also includes breaches of privacy, malicious falsehoods and defamation, harassment by the press & paparazzi, harassment by obsessive stalkers, harassment caused within the context of neighbour hood, nuisance and family disputes. Also included is harassment within the context of legal disputes, such as possession of premises, recovery of debts and commercial disputes.

Criminal Harassment

For people who have been charged by the police with offences including S4 and S5A of the Public Order Act 1986 (harassment, alarm or distress), S2 and S4 of the Protection from Harassment Act 1997 or charged with breaches of harassment anti-social behaviour orders and are facing prosecution in the Magistrates or Crown Court. We are members of the Criminal Legal Aid Scheme. We also offer fixed fees for certain charges that legal aid does not cover.

Employment Harassment (Work Place Bullying)

For people who are being harassed, bullied and/or discriminated against at work and/or employers facing such claims. This may include harassment, bullying, discrimination, victimisation due to sex, race, disability, sexual orientation or age with a cause of action in the Employment Tribunal. However where there are no Employment Tribunal causes of action (or the time limit has expired) then cases may be brought in the County or High Court, including under the Protection from Harassment Act 1997 and/or negligence and/or breach of contract.

Family Law Harassment

For people who are being harassed in a family law context by their spouse or former spouse and/or for those people who are defending accusations that they have been harassing spouses or former spouses. These proceedings are usually brought under the Family Law Act 1986 (non molestation and occupation orders) but can also be brought under the Civil Protection from Harassment Act 1997 (see our civil harassment page).

Harassment Legal Services

Harassment Legal Services is headed by Associate Solicitor and Head of Employment Riz Majid who has been dealing with harassment matters since he entered the legal profession ten years ago. He has a broad range of experience in all the areas of harassment outlined above, including acting in harassment claims for major corporations and acting in high profile and politically sensitive harassment matters. He designed Harassment Legal Services, the groundbreaking Harassment Law Database and our unique Harassment Protection funding and costs insurance package.

Harassment Law Database

The Harassment Law Database is a specially designed legal database. The contents include abstracts of academic and news articles, case law, statute law, court transcripts and judgments, relevant excerpts from Hansard as well as reference to practitioner’s text books, details of specialist advocates and academic experts, copies of claim forms, particulars of claim and court orders/injunctions from previous harassment cases. The Harassment Law Database is constantly updated to reflect the latest changes in harassment law and practice. This is probably the first and only legal harassment database that exists. We have found that referring to the database often gives our clients an advantage in harassment cases. This is especially true for borderline cases, where there are serious questions about what actually constitutes harassment.

Harassment Protection

Harassment Protection is our unique civil harassment litigation funding and costs insurance package. Under this package we are able to offer our clients a ‘no win no fee’ (Conditional Fee Agreement) arrangement which covers part or all of the legal costs that they incur with us. Harassment Protection also ensures our client’s have an ‘after the events’ (ATE) insurance policy. This protects our clients against any adverse costs order. Due to our niche harassment specialism we have delegated authority to grant ATE insurance polices directly.

Recent instructions have included:

  • Various claims under the civil provisions of the Protection from Harassment Act 1997.
  • Various Employment Tribunal claims of harassment/discrimination/victimisation including for race, sex, disability, age and sexual orientation.
  • Various claims (workplace related) under the civil provisions of the Protection from Harassment Act 1997 (including negligence / personal injury / breach of contract).
  • Alleged harassment by a national daily newspaper (includes defamation).
  • Defending a prosecution under the criminal provisions of the Protection from Harassment Act 1997.
  • Allegations of collective harassment by an international political pressure group (civil).
  • Allegations of harassment within a commercial ‘passing off’/breach of copyright claim.
