Probate, Wills & Trusts

Probate is the process that governs how your estate will be administered, according to the terms of your will - or the rules of Intestacy if you have no will.  It establishes what your assets are and who is entitled to what, then settles any debts and distributes the proceeds of the estate accordingly.  Neumans handles all aspects of probate from start to finish.  We can draft your will, amend an existing one, apply to probate court to act as administrators or advise on any entitlement under the will.  Where there is no written will, we advise on the laws governing how the estate should be distributed.  For larger estates, we provide tax services by dealing with the Inland Revenue to manage payment of inheritance tax and completion of tax returns.

Divorce & Matrimonial Advice

We know that this can be a difficult and distressing time for you and your family.  Therefore, we’re committed to working with you to minimise that stress, not only for the good of the family, but more importantly for the good of the children.  Our approach is to guide you through the process with compassion and understanding until the decree absolute is pronounced and your marriage is dissolved.  At Neumans, we’re always on hand to discuss any questions you may have about your legal rights in marriage or divorce.  We recognise that divorce is not always the only option.  You may want to remain married, but become legally separated or your religious beliefs may preclude divorce.  We can help you prepare a deed of separation or simply discuss the legal pros and cons of pursuing separation or divorce.  To protect your financial interests, we can apply to the Court for a freezing order if you believe that your spouse intends to dispose of assets or advise you how to proceed if your spouse has obtained an order against you.  For further information click through to Litigation.

Custody

When a marriage dissolves or a partnership breaks up, it is vital to consider the future of the children affected.  We can advise you on your legal rights and status regarding custody and negotiate arrangements – both financial and personal – to help minimise the negative impact on your children of your breakup.  Neumans can also continue to work beyond your custody agreement to ensure that family arrangements operate reasonably, if necessary through court proceedings.  We cover all aspects of custody arrangements, including with whom the children will live, the contact they have with the other parent, what happens if a parent wants to take the children to live abroad and what are the rights of the grandparents after marital breakdown.  Sometimes family breakdowns can extend to a spouse denying visitation rights – should this occur, we can make emergency applications to the Court to enable you to see your child or prevent your spouse from having access, where appropriate.  In cases of child abduction, Neumans will act immediately to seek all remedies to ensure that your child is safely returned home.  For further information click through to Litigation.
